Automatic Employment Authorization Extensions to End 

Introduction 

The Department of Homeland Security (DHS) has issued an interim final rule that will significantly change how employment authorization renewals are handled in the United States. The rule, announced in late October 2025, ends the long-standing practice of automatically extending Employment Authorization Documents (EADs) for many noncitizens who file timely renewal applications. This shift reflects DHS’s renewed focus on security, screening, and vetting procedures within the U.S. immigration system. 

What Happened 

Beginning October 30, 2025, non-citizens who file to renew their EADs will no longer receive automatic extensions of their work authorization while their renewal applications are pending. Only limited exceptions remain—such as extensions granted by law or through Federal Register notices for individuals with Temporary Protected Status (TPS). According to DHS and U.S. Citizenship and Immigration Services (USCIS), this change is intended to allow for more frequent background checks, deter fraud, and ensure that all applicants are properly vetted before their employment authorization is extended. Automatic extensions already in place before this date will not be affected. 

What This Means 

For many foreign workers and their employers, this rule could lead to temporary lapses in employment authorization if renewal applications are not approved before the current EAD expires. Non-citizens are now strongly encouraged to file renewal applications up to 180 days before expiration to minimize disruptions. Employers will also need to carefully monitor employees’ work authorization documents. While DHS frames the rule as a commonsense security measure, it is expected to increase administrative burdens for both workers and employers who depend on timely EAD renewals to maintain lawful employment in the United States.
